The President is directed to implement the National Nanotechnology Program to: (1) establish the goals, priorities, and metrics for evaluation for federal nanotechnology research, development, and other activities; (2) invest in federal research and development programs in nanotechnology and related sciences to achieve those goals; and (3) provide for interagency coordination of Federal nanotechnology research, development, and other activities undertaken pursuant to the Program. The National Science and Technology Council shall oversee the planning, management, and coordination of the Program. The Council shall prepare an annual program report, to be submitted to the appropriate congressional committees, at the time of the President’s budget request to Congress. The President shall establish a National Nanotechnology Coordination Office, with a Director and full-time staff, which shall: (1) provide technical and administrative support to the Council and the Advisory Panel; (2) serve as the point of contact on federal nanotechnology activities for government organizations, academia, industry, professional societies, state nanotechnology programs, interested citizen groups, and others to exchange technical and programmatic information; (3) conduct public outreach; and (4) promote access to and early application of the technologies, innovations, and expertise derived from Program activities to agency missions and systems across the federal government, and to United States industry. The President is directed to designate a National Nanotechnology Advisory Panel to advise the President and the Council on matters relating to the Program The Director of the National Nanotechnology Coordination Office shall enter into an arrangement with the National Research Council of the National Academy of Sciences to conduct a triennial evaluation of the Program. The Act directs that within 18 months after the enactment of this Act, the Secretary of Homeland Security (Secretary) shall take all actions the Secretary deems necessary and appropriate to achieve and maintain operational control over the entire international land and maritime borders of the United States, including: (1) systematic surveillance of the international land and maritime borders of the United States through more effective use of personnel and technology, such as unmanned aerial vehicles, ground-based sensors, satellites, radar coverage, and cameras; and (2) physical infrastructure enhancements to prevent unlawful entry by aliens into the United States and facilitate access to the international land and maritime borders by United States Customs and Border Protection, such as additional checkpoints, all weather access roads, and vehicle barriers.

It defines the term “operational control” as the prevention of all unlawful entries into the United States, including entries by terrorists, other unlawful aliens, instruments of terrorism, narcotics, and other contraband.

It directs the Secretary to report annually to Congress on border control progress.

It amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to direct the Secretary to provide at least two layers of reinforced fencing, installation of additional physical barriers, roads, lighting, cameras, and sensors within specified bounds.

It states that if an area has an elevation grade exceeding 10% the Secretary may use other means to secure such area, including surveillance and barrier tools.

It directs the Secretary to: (1) study and report to the House Committee on Homeland Security and the Senate Committee on Homeland Security and Governmental Affairs on the necessity, feasibility, and economic impact of constructing a state-of-the-art infrastructure security system along the U.S. northern international land and maritime border; and (2) evaluate and report to such Committees on U.S. Customs and Border Protection authority to stop fleeing vehicles that enter the United States illegally, including related training, technology, and equipment reviews. Petitioner Eric Michael Clark shot and killed a Flagstaff, Arizona police officer. Clark was charged with first-degree murder of a police officer. At trial, Clark sought to raise insanity both as an affirmative defense and as rebuttal to the prosecution's evidence of the mens rea element of the crime. The trial court ruled that, with respect to rebutting the mens rea element, Clark could not rely on evidence of mental incapacity short of insanity to negate mens rea. With respect to the affirmative defense of insanity, the trial court allowed evidence that Clark was schizophrenic, and adjudged Clark guilty on the finding that Clark failed to establish that his schizophrenia prevented him from knowing his actions were wrong, without explicitly considering whether Clark had the cognitive capacity to know what he was doing. On appeal Clark argued that failure to follow the traditional English two-part test for insanity known as the M'Naghten rule, which considers cognitive capacity as well as moral capacity, violates the Due Process clause. He also argued that disallowing mental incapacity evidence short of insanity to rebut mens rea violates the Due Process clause. The Arizona Court of Appeals rejected Clark's arguments. The Arizona Supreme Court declined Clark's petition for review. The U.S. Supreme Court granted Clark's petition for certiorari. The Supreme Court ruled against Clark on both issues. As to Clark's arguments regarding cognitive capacity, the Court stated that in light of the diversity of standards among American jurisdictions for the insanity defense, the traditional English two-part test, which separately evaluates both cognitive and moral capacity, has not risen to a constitutional principle. The Court moreover noted that as a practical matter, evidence bearing on whether the defendant knew the nature and quality of his actions is relevant to the issue of moral incapacity and is therefore admissible, irrespective of the test's formulation, and thus Arizona's abbreviated version of the test does not fall below the constitutional minimum. On whether due process requires that incapacity evidence be allowed to rebut the state's showing on the mens rea element of the crime, the Court held that Arizona's rule satisfies standards of "fundamental fairness" required by due process. The Court noted that it is constitutionally permissible for the burden of persuasion on insanity to be placed on the defendant, and allowing introduction of mental incapacity in rebuttal to the mens rea element would effectively shift this burden. It also noted that Arizona's rule may help prevent confusion and misunderstanding on the part of jurors. Therefore the undersigned judges of the Constitutional Chamber in accordance with the previous considerations and articles 424, 426 and 436 of the Code of Civil Procedure; and article 38 of the Law of Amparo in force declared: ABANDONMENT OF THE REMEDY OF AMPARO. -Spanish Sentencia Número 22 del 25 de Enero del 2001. Corte Suprema de Justicia. Sala Constitucional. La recurrente interpone Recurso de Amparo en contra de tres funcionarios del Ministerio de Construcción y Transporte, por haber emitido resolución donde le cambió el itinerario de la ruta que desde hace diez años tiene en concesión. Que con su actuación los funcionarios recurridos violentan los artículos 27, 32, 34 inciso 4; 46, 80 y 130 de la Constitución Política. La recurrente solicitó la suspensión del acto en apego a lo establecido en el artículo 31 de la Ley de Amparo vigente, el Recurso de Amparo interpuesto fue admitido; pero una vez analizadas las diligencias por la respectiva Sala se desprende que la recurrente a pesar de haber sido emplazada y notificada, la recurrente se personó fuera del tiempo establecido, situación que hace presumir una falta de interés en el Recurso de parte de la recurrente. Por tanto los suscritos Magistrados de la Sala Constitucional de conformidad con las consideraciones anteriores y los artículos 424, 426 y 436 del Código de Procedimiento Civil; y artículo 38 de la Ley de Amparo vigente declaran: DESIERTO EL RECURSO DE AMPARO. +186743|Improcedencia de Recurso de Amparo|Nicaragua|Boletin Judicial||2001-01-26|Personal property/Judicial review of administrative acts/Cooperative societies/Amparo/Civil procedure/Administration of justice/Government employees/Professional drivers/Transportation/Traffic/Constitutional law/Taxicabs/Municipalities||2001-01-26 -English Decision 27 of 26 January 2001. Supreme Court of Justice. Constitutional Chamber. The appellant in the capacity of President of the Cooperative of Taxi Drivers of Nicaragua, after many negotiations for obtaining an Operator's Permit, and prior to the authorization of the Municipal Mayor’s office of Estelí, proceeded to put into operation his small fleet of vehicles; but the Ministry of Transportation, Departmental Delegation of Estelí, through its Delegate, issued directions for them to stop immediatly the taxis from operating illegally, and an associate with the Traffic Police of Estelí came to stop these vehicles. It indicates the appellant in accordance with Law 290 (“Law of Organization, Competency and Procedures of the Judicial Power”), the Ministry of Transportation does not have competency to accept or to deny Operators' permits to Taxi drivers that operate at the intramunicipal level. The preceeding constitutes a violation to articles 24 paragraph 2; 25 clauses 2 and 3; 27, 29, 32, 33 and 80 of the Political Constitutional. Because of the above considerations, the appellant brought Remedy of Amparo against the Departmental Delegate of the Ministry of Transportation of Estelí and the Head of the Traffic Police of the same department. The Civil Chamber of the Court of Appeals of Estelí decreed with grounds the suspension of the demanded act. The Constitutional Chamber observes that the appellant in the writ of bringing the Remedy, said he acts in the capacity of President of the “Commander Franklin” Cooperative of Taxis Drivers of Nicaragua, but was not accompanied by the Special Power that makes reference to clause 5 of article 27 of the Law of Amparo. The appellant in the referred writ of bringing Remedy declares to have opposed the act against which he appeals, but no document is filed that affirms or asserts this statement, as is established in clause 6 of article 27 of the same Law of Amparo, a reason why the Constitutional Chamber considers that the appellant did not exhaust executive action. The Constitutional Chamber considers that the Court of Appeals had to be more careful in the transaction of this Remedy, having to have ordered to fill the omissions as it establishes the Law of Amparo in article 28. When examining the proceedings the Constitutional Chamber confirmed that the appellant did not fulfill the established deadline to appear, being extemporaneous his appearance, having to declare in accordance with article 38 of the Law of Amparo, deserted action brought by the appellant. Nevertheless, it is a criterion of the Constitutional Chamber that when in the Remedy of Amparo Illegality and Desertion coincides, the first must prevail, since the Law of Amparo establishes in article 27 the requirements that must contained in the writ of bringing remedy and previous examination of such, is possible to transact it or not by the Court. Therefore in accordance with statements, the mentioned Law, articles 424, 426 and 436 of the Code of Civil Procedure, and article 23, 27 clauses 5 and 6, 38 and 45 of the Law of Amparo, the Judges of the Constitutional Chamber resolve: THE REMEDY OF AMPARO IS DECLARED INADMISSIBLE. -Spanish Sentencia Número 27 del 26 de Enero del 2001. Corte Suprema de Justicia. Sala Constitucional. El recurrente en calidad de Presidente de la Cooperativa de Taxis Ruleteros de Nicaragua, después de muchas gestiones para la obtención del permiso de operación, y previa la autorización de la Alcaldía Municipal de Estelí, procedieron a poner a funcionar su pequeña flota vehicular, pero el Ministerio de Transporte, Delegación Departamental de Estelí, a través de su Delegado, giró orientaciones en el sentido que debía procederse de inmediato a la detención de sus taxis por estar operando en forma ilegal, y asociado de la Policía de Tránsito de Estelí, procedieron a detener sus vehículos. Señala el recurrente que de conformidad con la Ley 290 “Ley de Organización, Competencia y Procedimientos del Poder Ejecutivo”, el Ministerio de Transporte dejó de tener competencia para aceptar o denegar permisos de Operación a Taxis Ruleteros que operan a nivel intramunicipal. Que lo anterior constituye una violación a los artículos 24 párrafo 2; 25 incisos 2 y 3; 27, 29, 32, 33 y 80 de la Constitución Política. Por lo antes mencionado interpone Recurso de Amparo en contra de del Delegado Departamental del Ministerio de Transporte de Estelí y del Jefe de la Policía de Tránsito del mismo departamento. La Sala Civil del Tribunal de Apelaciones de Estelí, decretó con lugar la suspención del acto reclamado. La Sala Constitucional observa que el recurrente en el escrito de interposición del recurso, dijo actuar en su calidad de Presidente de la Cooperativa de Taxis Ruleteros de Nicaragua “Comandante Franklin”, pero no acompañó el Poder Especial a que hace referencia el numeral 5 del artículo 27 de la Ley de Amparo. Que el recurrente en el referido escrito de interposición del recurso manifiesta haber impugnado el acto contra el cual hoy recurre, pero no rola en autos ningún documento que afirme o constate su dicho, tal y como lo señala el numeral 6 del artículo 27 de la misma Ley de Amparo, por lo que opina la Sala Constitucional que el recurrente no agotó la vía administrativa. La Sala Constitucional considera que el Tribunal de Apelaciones, debió ser más cuidadoso en la tramitación de dicho recurso, debiendo haber mandado a llenar las omisiones como lo establece la Ley de Amparo en su artículo 28. Al examinar las diligencias la Sala Constitucional se constató que el recurrente no cumplió con el término establecido para apersonarse, siendo su personamiento extemporáneo, debiendo declararse de conformidad con el artículo 38 de la Ley de Amparo, desierta la acción interpuesta por el recurrente. In 2004, Arizona voters approved Proposition 200, which required voters to present proof of citizenship when they register to vote and to present identification when they vote on election day. Pursuant to section 5 of the Voting Rights Act of 1965, on 6 May 2005 the U.S. Attorney General pre-cleared the procedures Arizona adopted under Proposition 200. In May 2006, plaintiffs brought suit in the U.S. District Court for the District of Arizona challenging Proposition 200's identification requirements. On 11 September 2006, the District Court denied plaintiffs' request for a preliminary injunction, but did not at that time issue findings of fact or conclusions of law. On appeal of the denial of preliminary injunction to the U.S. Court of Appeals for the Ninth Circuit, on 5 October 2006, a two-judge panel issued a four-sentence order enjoining Arizona from enforcing Proposition 200 pending disposition of the appeal, without the benefit of the District Court's findings of fact or conclusions of law. On 12 October 2006, the District Court issued its findings of fact and conclusions of law, stating that while plaintiffs had shown a possibility of success on some of their claims, they failed to demonstrate a strong likelihood of success on the merits. Arizona and county officials applied to the Supreme Court for relief from the Ninth Circuit's injunction. On 20 October 2006, the Supreme Court issued an order construing the filings as petitions for certiorari, granting the petitions, and vacating the Ninth Circuit's injunction. The Court stated that the Ninth Circuit's failure to issue its own factual findings forced the Supreme Court to evaluate the injunction in light of the District Court's ultimate findings issued subsequent to the order. Because the Ninth Circuit gave no explanation that showed that the District Court's findings of 12 October 2006 were incorrect, the Court, in view of the impending November 2006 election and the necessity for clear guidance to the State of Arizona, vacated the Ninth Circuit's injunction, thereby allowing the election to proceed without an order suspending the voter registration rules. Oregon and Bustillo v. Johnson, the Supreme Court ruled that the suppression of evidence in a criminal trial is not an appropriate remedy for a state's violation of Article 36 of the Vienna Convention on Consular Relations (VCCR). The consolidated cases both involved review of state criminal convictions of foreign nationals who were not promptly informed of their ability under the VCCR to have their consul notified of their arrest. Petitioner Sanchez-Llamas, a Mexican national, was arrested in Oregon for attempted murder and other offences. When arrested, he was informed of his right to an attorney, but was not told that he could have the Mexican consulate notified of his detention. He subsequently made incriminating statements during an interrogation. Prior to trial he moved to suppress these incriminating statements on the ground of the state's failure to inform him of his right to consular notification. The motion was denied by the trial court, and he was convicted. His conviction was affirmed by the Oregon Court of Appeals and the Oregon Supreme Court. The Supreme Court granted certiorari. Petitioner Bustillo, a Honduran national, was arrested, charged with murder, and convicted in a Virginia court. He only learned that he could have had his consulate notified after he was convicted. After his conviction was affirmed on appeal, he filed a habeas corpus petition in the Virginia Court of Appeals arguing for the first time that his rights under Article 36 of the VCCR were violated. This claim was dismissed because he did not raise it at trial or direct appeal, and the Virginia Supreme Court affirmed. The Supreme Court granted Bustillo's petition for certiorari, and the Bustillo and Sanchez-Llamas cases were consolidated. The Court first discussed whether Article 36 of the VCCR creates a judicially-enforceable right to consular notification, but decided not to resolve this issue at this time, because, as discussed below, the petitioners here were not entitled to the remedies they were seeking even if such a right were assumed. The Court next turned to whether, assuming Article 36 creates a judicially-enforceable right to consular notification, suppression of evidence is an appropriate remedy. The Court ruled it would not be. The Court observed that the rights accorded a foreign national under Article 36 are different than those for which an exclusionary rule traditionally applies, such as unreasonable searches and seizures, in that Article 36 only provides a foreign national the right to have his consulate informed of his arrest, not the right to have the consulate intervene or to be free from police interrogation pending consular notice. Lastly, the Court considered, with respect to Bustillo's attempt to raise the Article 36 claim for the first time on habeas review, whether state rules governing procedural default of defenses apply to Article 36 claims. The Court followed prior Court precedent on this point, ruling that state procedural default rules may bar consideration of VCCR claims. The Court declined to follow decisions by the International Court of Justice on this issue.
